Collaboration with Tribes and Alaska Native Organizations Vital

My Inupiaq name is Iñukualuk and my Denaakk’e name is Tł’oyenaadleno. My English name is Jennifer (Maguire) Adams. I am originally from Allakaket, Alaska. My grandparents are the late Johnson and Bertha (Nictune) Moses of Allakaket and Alatna. My parents are the late Bob and Cora Maguire of Allakaket/Fairbanks.

I was hired by the University of Alaska Fairbanks College of Indigenous Studies as an assistant professor in the Department of Alaska Native Studies and Rural Development in September 2023. I believe that one of the reasons I was hired is because of my involvement with Alaska Native organizations and Tribes. My service on the board of directors for the Doyon Foundation offers a collaborative pathway for education projects with the University of Alaska, as well as the consultative work with my Tribe (Allakaket) on infrastructure and grant projects. Some of my colleagues are also engaged in Tribal projects that bring us closer to Tribes and Indigenous people in Alaska.

Examples of other collaborations that can help both the University and Tribes are: 

  • language revitalization,
  • workforce development, 
  • Tribal education projects, 
  • self governance,
  • Indigenous knowledge,
  • infrastructure projects,
  • cultural security and wellbeing,
  • state and federal government advocacy, 
  • problem-solving research that advances Native communities, etc.

These types of collaborations create two-way benefits for all involved – good for the University and good for the Tribes. For example, if the University collaborates with a Tribe to increase capacity in workforce development, there are funding streams and grants that can benefit both entities.

US Secretary of the Interior Deb Haaland spoke about the disconnect between education and tribal communities in her 2022 commencement speech at Haskell Indian Nations University. Higher education institutions can be agents of progressive change if they collaborate more with tribal communities. 

Tribal College Journal (TCJ) points out that an expert leader (of which Alaska Native tribal communities have many) needs to be identified to help produce the partnership effectively. TCJ also advises that when creating and sustaining a mutually beneficial partnership for all parties, it is also important to identify what should be done by other local government entities like boroughs, local chapters and schools.

Steps forward can start with identifying issues of common interest and developing resources that can be transferred. Alaska Native people, organizations and Tribes should have input into what types of career programs are most in demand, to help shape University offerings. Traditional knowledge should also be incorporated into higher education wherever and whenever possible. Drawing from the wisdom of Alaska Native Elders can only enrich the University. 

Applied research that will contribute to actual rural Alaska community development should also improve living conditions for those communities. The Nature Conservancy points out that Indigenous “communities collectively manage at least one-quarter of the world’s lands, 17% of all forest carbon, and vast stretches of freshwater and marine habitats. Their stewardship and management often achieve greater conservation results and sustain more biodiversity than government protected areas”. There is a lot to learn from Indigenous people about managing the environment.

Another example is at Arizona State University, where

the combined efforts of American Indian Studies and the School of Geographical Sciences and Urban Planning have helped support communities in the Navajo Nation in developing land use plans, updating older land use plans and supporting discussion and community education for economic development efforts and planning for new infrastructure projects.

ASU also has a mixed-reality game project called WaterSIMmersive where Indigenous students start a dialogue with tribal and rural community members…to better understand and voice their water concerns.

An example at the University of Alaska Fairbanks is the Tamamta Program, which is “centered on elevating 14,000+ years of Indigenous stewardship and bridging Indigenous and Western sciences to transform graduate education and research in fisheries and marine sciences”. 

It is not hard to imagine how the University can increase the benefits by cooperating with Alaska Native organizations and communities. Tribal people and communities can benefit as well. There are many exciting possibilities!

I look forward to bringing my students into this type of real-world community development, since it is beneficial to their learning and beneficial for Tribes to have a new generation to assist them with collaborative projects.

Good day! My name is Charleen Fisher, PhD. I am from Beaver, Alaska. My native name is Daazhrąįį. I am an Assistant Professor in the Department of Alaska Native Studies and Rural Development. 

This DANSRD Blog post shares about the Co-Create Collaborative and the work they do to contribute to and highlight ethical norms for working with Indigenous people in the circumpolar north. The group are like minded individuals who work together when it is important to do so. 

The Co-Create Collaborative is an unstructured group of Indigenous rights holders and Indigenous and non-Indigenous researchers who come together to write papers, organize and host workshops and presentations, and meet to share knowledge. I have worked with this group on several projects and will share about them here, please feel free to access the links and cite as you see fit.

This Sustainability, 2022, 14(3) 1331 publication is a foundational article that was worked on by researchers in 2021 and published in January of 2022. This paper advocated for co-creation or co-production of knowledge with Indigenous people and non-Indigenous researchers to be a priority and made recommendations for practical steps to be taken.

This article recommends strategies for transformative ways to integrate ethical research for meaningful collaboration in the area of research funding. There were 10 co-authors including Indigenous researchers and allies from the circumpolar north and Europe. The paper was published in Environmental Research Letters, Vol 17, No. 6 on June 10, 2022. The introduction was written by advocate Elle Merete Omma and highlights the Sápmi experience. This paper is steeped in helpful references and has a table with clear recommendations to research funders.

I was lucky enough to participate in a summer workshop in Potsdam, Germany with the Co-Create Collaborative. I held a workshop about identity, sewing, and research from an Indigenous perspective with co-create members and other people affiliated with the Research Institute for Sustainability – Helmholtz-Centre Potsdam (RIFS). I shared a presentation, my sewing and then we worked on a beading project.

WEMA III had so many great workshops with over 40 attendees at Oulu University in Oulu, Finland. I co-led a session titled Indigenous Knowledge, Language, and Positionality in Indigenous Research, facilitated by Ellen Marie Jensen (independent researcher) and Sigga-Marja Magga of the Giellagas Institute at the University of Oulu. I was so happy to share about the language work that I am involved in at the Tribal level. I shared the partnership website: https://gwichinlanguage.org/ and the materials that we work on and then did a hands-on sensory experience making a keychain with moose hide scraps, duck feathers, and glass beads. A report will be made available soon summarizing our workshop.

Letter to Students – Professor Jenny Bell Jones

May 2016 DANSRD Graduation Celebration.

Greetings to you all! By the time you read this my journey on our beautiful planet will be over and I will have taken my last walk into the forest. I want you all to know what a huge honor it has been to be a part of your lives. You, and in many cases your families as well, have brought great joy to me through the years that we worked together, and especially during my last years when illness made me homebound. It is not the Native way to say goodbye, and this isn’t a goodbye, it is a “I’ll see you later” or “hágoónee’”.

No more grading papers late into the night for me, no more sending out just one more email trying to make sure that everybody got their assignments in on time. No more developing those quizzes and writing those lecture notes that I’m sure some of you groaned about when you found how much reading they would require. Those things I will not take with me. The things I will carry along are the wonderful memories I have from each time I saw one or another of you have another success. Sometimes those successes were small, sometimes they were large, it never mattered to me, just seeing them was what counted. Nobody was happier about your good grades than I was!

Sometimes I was aware that you were struggling with incredible challenges in your lives. Some of you came to me and talked to me in confidence about those challenges and that confidence has never been shared. Sometimes I sat up all night like a worried grandma trying to figure out how best I could help you. Sometimes there were things I could do, and other times all I could do was pray but I want you to know that I was always there doing it.

Know that you can succeed. Do your best work and then try to make it just a tiny little bit better. You don’t have to be perfect just do your best. Take what you have learned in our classes and programs and use it wisely. Be proud of your successes, and forgive yourselves when you do not do as well as you had hoped … you are often your own worst critics, chances are the rest of us think you did pretty well!

When I was diagnosed with ALS in 2010 I was told I had just a year or two. I had a choice. I could have resigned my position, filed for disability and let the illness take over. Or I could continue working for as long as I was able. I chose the second option because of all of you. And those of you who I have worked with through these last 12 years they had told me I would not have, have given me a gift that I cannot repay. You gave me a purpose and reason to keep fighting. A reason to keep loving life for as long as I possibly could.

So, now it is time for you to pick up that fight. Sing for me, dance for me, eat some Native food for me, spend some time out on the land with me, but please do not be too sad for me. I have been blessed with many good years and especially the ones I have spent with you. I am at peace now, please be at peace with me. Remember when we walk on, we do not walk away. If you want to talk to me, go sit outside somewhere and be very quiet and listen … I’ll be there.

“DANSRD Remembers Dr. Gordon L. Pullar Sr.” by Jenny Bell Jones

On behalf of the Department of Alaska Native Studies and Rural Development staff, faculty and students I extend our deepest condolences to the family of Dr. Gordon L. Pullar Sr. who took his final walk into the forest on April 18th.  His family including his son, Gordon Pullar Jr. his daughter in law Diana Rose Pullar, his grandson Little Gordy, his wife, Flossie Leavitt-Pullar, daughter Tracy Pullar Cascio and all other family members are in our thoughts and prayers.

Dr. Pullar was a huge part of DANSRD and UAF for 20 years. He retired in 2014 with Emeritus status after serving first as Director of the Alaska Native Human Resource Development Program and then as Director of the Department of Alaska Native and Rural Development (now DANSRD), but he continued to work on some in progress graduate committees into 2016. He was revered not only for his academic brilliance that shone through in a long list of scholarly publications, but also for his willingness to help all students no matter what the question was, and most of all for his overall kindness to everyone he encountered. He served on my graduate committee and then, when DANSRD hired me, insisted that I drop the “Dr.” and just call him Gordon. A difficult task for someone who had placed him on a very high pedestal but I am remembering it here and will honor his request for the remainder of this piece.

Gordon’s focus on teaching came about because of his commitment to students and his strong scholarly interests – – especially in leadership, in the Alaska Native Claims Settlement Act and the events leading to its passing, and in cultural preservation and documentation.  He was known internationally for his work in those areas.  With those areas of expertise, he created the graduate symposium on Circumpolar & Indigenous Leadership, which was to serve as a foundation course for graduate students in Rural Development.

Gordon touched the lives of so many both within DANSRD and in the larger Alaskan community. He served on the Tangirnaq Native Village Tribal Council, the Koniag Education Foundation, the Alaska Federation of Natives Board of Directors, and as President of the Kodiak Area Native Association. He guided so many of us through graduate programs and then continued to mentor us as we went out into the world. We always knew we could count on him for feedback or answers to all the crazy questions that grad students come up with. His lessons were well learned by many, and he left a legacy of coursework and good solid advice which will be used long into the future.

We are happy that Gordon got to spend his last years with a wonderful wife and was able to take some nice vacations that were shared on Facebook. Those who met him along the way know that he had worked long and hard for that time off. Gordon was an athlete as well as a scholar and there will be no limits on that now. May his spirit soar with the eagles and his feet run forever free!

Service will be on May 5th at 3p.m. at the First Presbyterian Church in Anchorage.

“An Outsider’s Thoughts on ANCSA” by Emeritus Professor Jenny Bell Jones

ANCSA changed the lives of everybody in Alaska. Whether you are Alaska Native, non-Native, or some “other” kind of Native as I am, your life has been affected by ANCSA if you have spent any length of time at all in the state. Alaska would not look the way it looks today were it not for the Act and the Corporations it created. ANCSA is woven throughout everything that happens in the state today and we cannot really understand what is going on unless we understand ANCSA.

Now for a disclosure, I am not an ANCSA shareholder. I am however an example of some of the many ways that non-shareholders have benefited from the legislation. I have a number of relatives and many friends who are shareholders.  I have been a scholar of the Act for a long time and I want to say “thank you” to all of those whose hard work made ANCSA possible.

ANCSA marked the beginning of a new chapter in my life. The very first class I ever took at UAF was an Alaska Native Studies course about ANCSA. This was in 1999 and, for the next 22 years, I would study ANCSA from every imaginable angle. Subsistence, law, the Doctrine of Christian Discovery, economics, finance, land management, tribal law, climate change, culture, ANCSA was always there. ANCSA guided my studies through 3 different degree programs. It provided me with the backdrop for all of my studies in Rural Development, and international indigenous law. Jobs with three different Regional Corporations helped me pay my way through school. I would go on to teach courses on the Act, and continue to study it today. I could not have had the successful academic career that I enjoyed without the help of ANCSA.

As I learned about the land claims period during the 1960s I was struck by how easily those who were fighting to protect the land could have failed. Their cause was not popular in Alaska which had a significant non-Native population that opposed any form of settlement. My study of territorial history found anti-Native racism so deeply embedded as to be invisible to much of the population that were perpetuating it.[1] A settlement was never a given. The men and women who fought for it are to be commended for succeeding against incredible odds. And we must remember that what they got was an Act of Congress, not a treaty or a negotiated settlement. It was not perfect but it was the best they could get: a tool to be used for the future. And an amazing achievement given what they were up against!

The 1990s/early 2000s was an exciting time to be a part of the Rural Development program at UAF. Through coursework, guest speakers and seminars, students had the incredible privilege of meeting many of the amazing people who, through hard work and sacrifice, had made ANCSA happen. Dr. Emil Notti, Dr. Willie Hensley, Dr. Gordon Pullar, Miranda Wright, Fred Bigjim, Jim LaBelle, Dixie Dayo, Darlene Wright, Alfred Ketzler Sr. and many others. Some are gone now:  John Borbridge, Senator John Sackett, Dr. Walter Soboleff, Byron Mallott, Alice Petrivelli, Charles Etok Edwardson Jr, but they shared their wisdom before they left us. These were people who played active parts in the land claims movement of the 1960s and then the implementation of the Act that followed. They gave generously of their time and encouraged us all to continue our studies and I for one am very grateful for their input.

It did not take long however for me to see that not everything in the ANCSA rose garden was perfect. As I became more assimilated into the Alaska Native community I realized that all was not well. I attended an unreasonable number of funerals. I comforted far too many friends who had lost children to suicide and accidents. There was poverty in many communities along with a lack of basic developments like water and sewer systems and responsive law enforcement. The State had unreasonably high levels of drug and alcohol abuse and I became very aware of the extreme levels of violence and sexual assault that persisted. In 2013 the Indian Law and Order Commission deemed public safety to be such a concern in rural Alaska that they devoted an entire chapter of their Report to Alaska.[2]   

Unemployment and homelessness rates were disproportionately high for Alaska Natives throughout the State. In many villages, unemployment topped 50% and what jobs there were skewed towards “government work” indicating a lack of private investment. Incarceration rates were also disproportionate and I observed some blatantly unjust court decisions that harmed Alaska Natives. I personally experienced the biased justice system on more than one occasion.

I learned that tribal governments had been omitted from ANCSA leaving them with very little in the way of resources to provide governance in their communities. I saw that there was often little in the way of partnership between ANCs and Tribes even though they served the same population. Tribes lacked the kind of territorial jurisdiction they needed to provide effective governance. Not everyone agreed about the kinds of development that were needed and who should pay for them.

There was active war ongoing between Tribes and the State of Alaska. The state of Alaska was spending large amounts of money disputing with tribes over the most basic parts of tribal sovereignty. These protracted legal battles consumed limited funds and energy from Tribes that could have been better spent in their communities. The state was spending public money to fight against its own citizens at the same time that it cried poor when asked to fund services in their communities.[3]

Today, subsistence continues to be a legal battle field. At least 60 disputes regarding subsistence went through the court systems during ANCSA’s first 50 years. And there are more coming. The extinguishment of aboriginal hunting and fishing rights in section 4(b) of ANCSA[4] has never been resolved in a way that worked for Alaska Native communities and the cost has been huge for everyone involved.

I understood then why some of the people I met were not happy with ANCSA and said that ANCSA was intended to terminate their very existence. Clearly there was still more work to be done. How might these conditions be improved?

Do I think that all the shortcomings I have noted are solely the fault of ANCSA? No, of course not.  there is far more to it than that. For instance, Congress could have passed legislation to correct the subsistence problems it failed to correct within Title 8 of the Alaska National Interest Lands Conservation Act (ANILCA).[5] The State could have worked to develop subsistence law that would withstand legal challenge, perhaps learning from Hawaii’s Constitution.[6] The State of Alaska could have long since chosen to recognize Tribes and partner with them instead of fighting expensive court battles. There was nothing in ANCSA that forbade better working relationships between ANCs and Tribes. If the State had been able to meet its obligations in terms of law enforcement in the villages we would not be in the unenviable position of having our own chapter in the Indian Law and Order Commission’s Report. Obviously ANCSA was not the sole culprit but it did include a mandate to address “the real economic and social needs of Natives,”.[7] Could it actually do this? Were there tools hidden within the Act that were not being fully utilized and/or content that could be further amended that would go a long way to addressing some of the complaints.

The next 50 years.

When the Dawes General Allotment Act was passed in 1887 there was an expectation that assimilation would be complete within twenty-five years and Lower 48 Indian lands would become available to non-Indian buyers.[8] (This was supposed to benefit Indians both economically and socially). Things did not work out that way. Millions of acres of Indian lands were lost, and tribes were impoverished, and it has taken over 100 years for some Lower 48 tribes to recover while for others the work is still in progress. Those tribes did not give up, they did not just let go, and they used all the tools available to them to survive, but it took another Act of Congress, the Indian Reorganization Act in 1934, to slow the destruction. ANCSA has only been around for 50 years so, before we wonder why everything is not yet perfect, we might compare where we are now with where Lower 48 tribes were 50 years after the Dawes Act.  Alaska Natives have been using the tools, and in some areas the progress has been remarkable. Other areas still need work but we are in a much better place than the Lower 48 was 50 years after the Dawes Act.

When we look at the wording of the original ANCSA it seems remarkable that we are celebrating the 50th birthday. It was not intended to be this way. Hidden away in Section 7 was the following termination language:

Sec. 7. (h)(3) On January 1 of the 21st year after the year in which this Act is enacted, all stock previously issued shall be deemed to be canceled, and shares of stock of the appropriate class shall be issued without restrictions required by this Act to each stockholder share for share.”[9]

This language would have removed all the restrictions on the ANCSA shares after 20 years and placed them on the open market at which time they could have been freely sold by the Native shareholders, and bought by anybody who wished to participate. If this would’ve happened we can be sure that the landscape would look very different today and it would not have been positive for Alaska Native cultural continuity. Thanks to the “1991 Amendments”[10] the shares remain in restricted status today. The statute looks very different now and readers are encouraged to compare the original Section 7 with its update in the U.S. Code.[11]

It is tempting to take the position that because this sunset clause was amended to protect the Native ownership of the corporations, there is nothing more to worry about and we can simply move on. If we look carefully though, this is not the case. There have been numerous amendments to ANCSA but, most of these involve property rights. With the exception of these amendments, we still have a piece of legislation that has been in place for 50 years that was originally crafted around speedy assimilation if not outright termination. There are still many of the parts of ANCSA that are not working well in terms of the social and economic well-being of Alaska Natives today which can be traced back to the expectation of speedy assimilation and the understanding by Congress that Section 7 (h)(3) would be implemented.

Shareholder Continuity: If Sec. 7 (h)(3) had not been amended enrollment would have not been an issue after 1991. Thirty years later continuing enrollment is very important if the ANCs are to continue their work. ANCSA was amended to allow shareholders from each Corporation to vote to issue shares to Natives born after the December 18th 1971 cut off date. To date, six Alaska Native Corporations (ANCs) and some Alaska Native Village Corporations (ANVCs) have voted to do this.[12]

Blood quantum requirements are often raised as a complaint about ANCSA but these were actually addressed in the 1991 Amendments. Section 2, Definitions, now includes:

“(r) “Descendant of a Native” means

  • a lineal descendant of a Native or of an individual who would have been a Native if such individual were alive on December 18, 1971, or (2) an adoptee of a Native or of a descendant of a Native, whose adoption (A) occurred prior to his or her majority, and (B) is recognized at law or in equity;”[13]

Shareholders can vote to enroll “new Natives” using linear descent rather than blood quantum, but only a couple of the ANCs (ASRC and Calista) have chosen to do this.[14] So, shareholders do have an option to vote to both enroll new Natives, and to remove the blood quantum requirement if they so choose. There are tools there to insure shareholder continuity if Corporations and shareholders want to use them however there could be future downsides to eliminating the blood quantum requirement that would need to be considered. If, for instance, a large percentage of current shareholders reside out of state as indicated in a 2012 GAO report,[15] their children who would qualify to be shareholders via lineal descent might have little or no connection to the land and see no reason to retain it in the future.

Tribal governance: ANCSA was silent on tribal governance in spite of having been presented by some as self-determination legislation. The Native leadership pursuing land claims could only do so much. Their primary focus was on securing the land. The omission of provisions for governance was unexpected. In Alaska Native Rights, Statehood, and Unfinished Business, Robert Anderson states:

It is understandable that Native leadership at the time would not have seriously considered that settlement of land claims necessarily diminished the authority of Native tribal governments. There were over 70 villages organized under the Indian Reorganization Act at the time, and most others operated under some form of traditional council governance.”[16]

Why did Congress ignore these governments? ANCSA’s failure to provide for self-governance speaks to the reality of the legislation as a property rights settlement, as well as to how Tribes were viewed in Alaska in 1971. Whatever the thinking may have been 50 years ago, it is now time to correct this and support the Tribes so that they can provide better governance. While in theory, a Village Corporation can convey some (or even all) of its land to a Tribe, this may not be the best solution. It leaves the land without the protections against alienation that ANCSA provides, and the Tribe may or may not be able to place that land into trust to gain Indian Country status and regain the protections.

It is up to Tribes and Corporations to come together and decide what they want for the next 50 years. There is no one size fits all so amending ANCSA cannot be the only solution. It should however at least be considered. Is Sec. 14 (c)(3) working to the best interests of the Native beneficiaries of ANCSA? If not, what would a better arrangement look like? Tribes, Municipalities, and Corporations need to work together to craft a workable amendment, and then gain the support of our congressional delegation to get the Act amended.   

Subsistence: This is perhaps the biggest failing of the Settlement and the hardest to fix. As noted earlier, there have been more than 60 subsistence related cases argued in court since the passage of ANCSA. This is a glaring failure of one of the mandates of the Act calling for the settlement to be “accomplished rapidly, with certainty, in conformity with the real economic and social needs of Natives, without litigation,”[17]  (bold font added). Subsistence is vital to both the social and economic needs of many Native communities. The existence of so many court disputes shows how badly ANCSA has failed in this area. Interestingly, very few of the court battles include ANCs or ANVCs as litigants; this expensive and time-consuming work has been left up to Tribes and individuals.

The courts are not the right place to obtain permanent protection for subsistence. A favorable court decision is only protective until it is overturned later on. Legislation at both the state and federal levels is needed. ANCSA has provided Alaska Natives with considerable political power but that power has not been sufficient yet to obtain meaningful changes to Alaska’s laws. Congress needs to take action but to get that action the ANCs, the ANVCs and the State will need to get behind that effort. And everyone will need to be on the same page in regards to what the fix will actually be.

Settlement Trusts and Endowment Models: What about the economic future for shareholders? What will we do when one or another ANC fails? Robert Sniggeroff and Craig Richards discuss this possibility in a 2021 Law Review article pointing out that all businesses have a natural lifespan and therefore we cannot expect them to support cultural continuity indefinitely.[18] The authors discuss the dual missions of ANCs to both create shareholder wealth and promote cultural continuity, and present some interesting options for the use of settlement trusts and other forms of trusts that some corporations are beginning to explore. Maximizing shareholder profit and wealth is not the only objective of an ANC.[19]  Sniggeroff and Richards suggest an endowment model similar to the Alaska Permanent Fund, noting that:

 “Operating business models are inconsistent with the very long-term life cycle of cultures. Endowment models are more consistent in terms of risk and longevity and are equally if not more consistent in terms of immediate cultural impact.[20]

ANCSA made provisions for the establishment of Settlement Trusts as part of the 1991 Amendments but there was not a lot of interest until the 2017 Tax Act opened the possibility of using them to reduce tax liability.[21] Since then some ANCs and ANVCs have encouraged shareholders to vote for their establishment. Sniggeroff and Richards note that Settlement Trusts will need to be used for more than the pass-through of corporate profits for tax purposes if they are to survive into the future as a support for cultural continuity and shareholder economic well-being.

Benefit Corporations: Could an ANC change its corporate structure to allow it to better support cultural continuity? In 2016, William Robinson discussed the possibility of the Benefit Corporation or B-Corp model for ANCs.[22] Proposed legislation to allow Alaska businesses to incorporate as B-Corps in 2017 did not move forward, but there is interest in the state and it is likely that Alaska will eventually join the majority of states that already have similar statutes. If we do, then this option would be available to shareholders if they decided to choose that route. B-Corps continue to operate businesses for profit but are also legally obligated to consider how their activities will benefit the public. A B-Corp could, for instance, do more to help Native communities maintain their subsistence lifestyles or provide funding to Tribes to build infrastructure in a community where not all the residents were shareholders. If Alaska enacts a benefit corporation statute this would provide ANC and ANVC shareholders with an alternative legal entity to consider.[23]

We should note that ANCSA already includes language that allows an ANC to lean towards what a B-Corp might provide should they wish to do so:

“(r) Benefits for Shareholders or Immediate Families. The authority of a Native Corporation to provide benefits to its shareholders who are Natives or descendants of Natives or to its shareholders’ immediate family members who are Natives or descendants of Natives to promote the health, education, or welfare of such shareholders or family members is expressly authorized and confirmed. Eligibility for such benefits need not be based on share ownership in the Native Corporation and such benefits may be provided on a basis other than pro rata based on share ownership.[24]

A change to B-Corp structure could not take place without a majority of shareholders voting for it and it would require a significant education effort in advance of that vote.

 Conclusion

Yes, the ANCs are doing very well in the business world. They are making great contributions to the state, paying dividends to shareholders, supporting scholarships and other forms of philanthropy, and providing funds to the various nonprofit organizations. They are employing Alaskans, both shareholders and non-shareholders. In these areas ANCSA continues to be a success. As noted in the GAO report for 2011, “The regional corporations provide a wide variety of benefits to their shareholders and other Alaska Natives. Under the Settlement Act, the corporations are authorized to provide benefits to promote the health, education, or welfare of shareholders and other Alaska Natives, but they are not required to do so.”[25] (bold font added) In some cases, ANCs and ANVCs  are doing these things in ways that are not obvious to all.

But there is more to life than money. Social conditions in many of Alaska’s Native communities continue to be sub-standard. Alaska’s tribal governments struggle without a land base and are overly dependent on federal funding. Communities lack proper law enforcement. There are continuing questions about the future of younger Alaska Natives who are not shareholders and how they will participate in the Settlement in the future. ANCSA was not designed to last forever in its current form and it is now time for young shareholders and tribal citizens, who are sometimes but not always the same people, to come together and decide what they want for the future and how to achieve it.

Is Our Money Misbehaving? Part 1: Money and Traditional Values – Guest Post by Emeritus Professor Jenny Bell Jones

If you are an Alaska resident you probably just got your Permanent Fund Dividend (PFD). The State of Alaska paid out $1600 to every qualified Alaskan during October. The money is “free money’, the only thing we have to do to get it is fill out a short form, and we can spend it any way we like. It is free for the State too … all they have to do is go out to the money tree and pluck the amount they need to pay for the PFDs … Well, maybe not.

OK, now I got your attention so let’s talk about money a little more carefully. How well is that money behaving? What part does it really play in our lives and who is in control? Do we control money or does it control us? Where does the money come from and how does it affect our ability to adhere to Native values that we have been taught have their roots in “cashless’ societies … values that teach us to share with and care for others?

Whose values you ask? Good question, because there is no one universal set of Native values and by no stretch of the imagination do all Native people adhere to the same values today. For the purpose of this article I used the ones I myself live by which have their closest cousins in the Athabascan Values agreed upon at the 1985 Denakkanaaga Elders Conference (https://www.ankn.uaf.edu/ancr/values/athabascan.html). You can find other sets of values for different Alaska Native groups and all are pretty similar in terms of reminding us to share, work hard, show responsibility to our communities, and respect and care for elders and children. All of them stress respect for the land and for Native traditions and urge us to be honest in all that we do. None of them talk directly about money so now we will take a look at where money fits into those value systems.

Money has been around in one form or another for a very long time although it has been utilized differently by various groups. Before money in the form of cash came along, societies had different items of value that they used in the process of trade. While cash as we know it now (coins, paper money etc.) may be relatively new in some Indigenous communities, trade has been around for a long time. Can we say that we are practicing Native traditions when we use money? Perhaps not, but how we use it certainly can (and should) connect back to those traditions and values. The money itself is nothing more than a medium of exchange, a tool that we can use wisely or unwisely as we choose. Wise use of resources seems to be a pretty universal Native value.

The question we might ask ourselves is this: “How do we take a tool which has been used by some for a long time to support systems which perpetuate inequality and unfairness, and instead use that same tool within our own systems to do the opposite; insure equality and fair treatment for everyone?’

Indigenous Peoples did not participate haphazardly in trade. They placed a value on different items and expected certain amounts of other items in return when they traded with each other or with neighboring tribes. When they began trading with colonists and long distance partners the trading networks expanded and over time began to include cash in some of the transactions. The more expansive the trade network became, the more likely you were to see money involved, until we reached the point we are at today where the large majority of business transactions in North America involve some exchange of cash. Responsible involvement in the trade network certainly met the Athabascan values of self-sufficiency, hard work, and care and provision for family and can continue to do so today especially if we respect the knowledge and wisdom that can be gained from life experiences. The initial incorporation of money into the traditional systems did not result in the widespread abandonment of values.

But itself money is not a bad thing and it allows a much wider range of goods and services to change hands than could ever take place otherwise. It would be very difficult for instance to exchange bead work for a plane ticket to Anchorage or to try to pay the utility bill with a bag of dry meat. Both of those items are very valuable in some communities but that value cannot be readily changed into plane maintenance or diesel fuel. When used this way to pay for things we need, money can provide support for the practice of all the values we hold dear. When new tools arrived in Native communities, people decided if they worked well or not. They kept on using those which did and discarded those which did not. Money is a tool and a good one if it is used wisely. We do not have to abandon our values to use this tool but we do need to control its behavior.

Problems arise when we stop controlling the behavior of our money and it starts to take on a life of its own. When we start valuing money for its own sake and trying to accumulate far more than we actually need, it becomes much harder to align our use of money with our Native values. We are surrounded by a wider system that helps us to allow our money to misbehave. That system encourages us to spend more than we have, and to buy all manner of things we do not really need. We are also encouraged to support development that damages our lands and waters so that we can have more money to spend. This system does not encourage sharing with others. Instead, it rewards those who accumulate lots and do not share. When acquiring more money than we need becomes a goal, even if it comes at the expense of our lands, communities, and future generations, we have gone beyond the healthy incorporation of money, and added something new to the traditional system by sanctioning uncontrolled acquisition.

When we allow organizations we are involved with to focus on wealth accumulation at the expense of everything else, we find ourselves even further removed from those traditional value systems. Now we are turning control of the money over to someone else and washing our hands of the responsibility for how it behaves. We are hoping that somehow those organizations will be held accountable, and contribute in some way to our future well-being, but we are not doing our part to control the behavior of the money very well.

Using money while staying true to our values requires that we understand the financial system, and be prepared to take control and say no to things that do not align with those values. It means understanding investing and about things like taxes and why we pay them. As communities grew in permanent locations the need for communal-use facilities increased. Schools, roads, hospitals, tribal halls, libraries, recreational facilities … all of these require much more money than a few individuals could provide so we use taxes to pay for them. None of us expect to have to shoulder the entire cost of fixing the school roof but most of us love children and are willing to pay a little towards it. We love and respect elders and do not mind contributing to programs that help them. We do that when we pay our taxes.

Public education is especially important. Private industry requires employees to have all sorts of skills but, in general, those industries expect the employees to have acquired those skills elsewhere. Imagine how expensive it would be for today’s businesses and corporations if they had to teach prospective employees to read and write! On a more personal level, think about how difficult things would be if every family had to teach all the basics to their own children with no support from the state. At least one parent would need to stay home and be a full-time teacher, assuming they had the skills to do this. The world we live in now cannot operate without public education so it makes sense that we all contribute to cover the cost and insure that we can continue to participate in the economy.

When businesses or individuals say they want to “save money on taxes’ this really means they want to spend the money on something else for their own good rather than contributing that money to the public good. It may be legal to do so but is it really fair and honest … does tax avoidance fit well with traditional values of sharing and caring about communities? What would have happened if people in subsistence-based communities had withheld labor and resources but then expected an equal share of the annual catch of salmon? When we view taxes as some kind of unfair burden rather than our way to contribute to everyone’s well-being, and find ways to avoid paying them, there will be less money for the public services we all need and use.

If too many tax payers find ways to avoid paying their share, many of the things we use will be unavailable. Almost all of the federal funding for tribal programs is derived from taxes so tribal citizens will suffer. If schools are underfunded children suffer. If we lack proper law enforcement everyone in the community suffers. If Medicare and Social Security are raided to make up for the shortfall, elders suffer. Tax cuts may sound good on paper but they are not free; we will absolutely have to pay for them. Money goes around in a circle and when we disrupt part of that circle the progress stops.

In an article on shopping locally, Jeremiah Moss suggests that we need to act like citizens rather than consumers when it comes to controlling the behavior of our money and I agree.[1] Instead of blindly following along and placing the acquisition of more money in front of everything else, we must look at the big picture. Our elders knew that if we trapped too many beaver or caught too many fish there would not be enough in the following years. If we demand more free money in the form of larger PFDs there will less to go around in the future. If wealthy people and large businesses avoid paying taxes there will be fewer services for all of us and eventually even the tax-avoiders will suffer.

At some point we all have to stop taking out and put something back in the same way as those elders preserved the animal populations by “resting’ different areas from hunting over time. Those who are taking out the most need to set an example by limiting their take and making sure their use of money is not hurting others. When we all start being more conscious about how we control our money we will have taken a step in the right direction to properly incorporate its use into our Native value systems.
